These Terms and Conditions (the “Terms”) govern access to and use of the website mosaicohostel.com (the “Website”), owned and operated by MOSAICO BOUTIQUE HOSTEL SL (“we”, “us”, the “Company”).
Browsing the Website attributes the status of User and entails full and unreserved acceptance of these Terms. If you do not agree with any of the provisions set out below, please refrain from using the Website.
2. Pre-Launch / Informational Nature of the Website
The Website is, at the date of these Terms, in a pre-launch phase and has an exclusively informational, promotional and marketing purpose. It presents the hostel brand concept, its experience, room types, articles and content for solo travellers, digital nomads and other audiences.
The Website does not currently offer any booking engine, reservation system, online payment functionality or user account creation. Any content describing rooms, prices, locations, openings, dates or experiences is purely indicative and does not constitute a binding commercial offer.
Submitting your contact details through any form available on the Website does not create a reservation, accommodation contract, guarantee of availability or any other binding obligation between the User and the Company.
3. No Booking Contract / No Guarantee of Future Services
Until a booking system is expressly launched and made available on the Website with its own specific terms, no contractual relationship for accommodation, hospitality or any related service is created between the Company and the User.
The Company makes no guarantee, express or implied, regarding (i) the opening date of the hostel, (ii) the availability of rooms, services, prices or experiences, (iii) the geographical locations referenced, or (iv) the future launch of any reservation, payment or membership feature.
The information published on the Website may change without prior notice. The Company reserves the right to modify, suspend or discontinue any content, page, section or functionality, including the entire project, at any time and without liability.
4. Acceptable Use of the Website
The User undertakes to use the Website diligently, lawfully and in accordance with these Terms, good faith and public order. In particular, the User shall not:
(a) use the Website for unlawful, fraudulent or harmful purposes;
(b) introduce viruses, malware or any technology that could damage the Website or its systems;
(c) attempt to gain unauthorised access to any part of the Website or its related systems;
(d) collect or harvest data from the Website by automated means without prior written consent;
(e) reproduce, copy, distribute, transform or publicly communicate the contents of the Website beyond what is permitted by applicable law or by these Terms;
(f) use the Website in a way that could damage, disable, overburden or impair its functioning.
The Company reserves the right to deny or restrict access to the Website, without prior notice, to any User who breaches these Terms or applicable law.
5. Minimum Age and Minors
The Website is exclusively for users aged eighteen (18) or over. By accessing or using the Website, or by submitting any information through its forms, the User represents and warrants that they are at least 18 years old and have the legal capacity to accept these Terms.
The content of the Website — including, without limitation, information addressed to solo travellers, digital nomads, and topics related to travel, lifestyle and accommodation — is designed for an adult audience.
Newsletter, waitlist, interest and contact forms may not be completed by minors under 18. The Company does not knowingly collect personal data from minors through the Website. If the Company becomes aware that personal data of a minor has been submitted, it will delete such data without undue delay and may suspend access to the Website.
Where a minor accesses the Website, such access shall take place under the exclusive responsibility and supervision of their parents or legal guardians, who shall be responsible for any use made of the Website and for any data submitted through it.
The minimum age requirements applicable to any future booking, check-in or accommodation services will be established in the specific terms and conditions governing those services at the time of their launch, and may differ from the minimum age set out in this section.
6. Intellectual and Industrial Property
All contents of the Website — including without limitation texts, graphics, logos, icons, images, photographs, audiovisual content, brand names, trade names, software, source code, design, structure, selection and arrangement of contents (the “Contents”) — are the exclusive property of the Company or its licensors, and are protected by Spanish and EU intellectual and industrial property law.
Access to the Website does not grant the User any right or licence over the Contents, beyond what is strictly necessary to browse them. Any reproduction, distribution, public communication, transformation or use of the Contents not expressly authorised in writing by the Company is prohibited.
The brand MOSAICO, its logo and any associated distinctive sign are trademarks or trade names protected in favour of the Company. Their use without authorisation may give rise to civil or criminal liability.
7. External Links and Third-Party Content
The Website may contain links to third-party websites or platforms (including social networks). Such links are provided for the User’s convenience only. The Company does not control the content, policies or practices of such third parties and assumes no responsibility for them.
Access to third-party websites or services from the Website is at the User’s own risk and is governed by the terms and privacy policies of those third parties.
8. Limitation of Liability
The Website and its Contents are provided on an “as is” and “as available” basis. To the maximum extent permitted by Spanish and EU law, the Company excludes any warranty, express or implied, regarding the accuracy, completeness, reliability, availability, suitability for a particular purpose or non-infringement of the Contents.
The Company shall not be liable for any direct, indirect, incidental, consequential or special damages arising from (i) the use of or inability to use the Website, (ii) any decision made or action taken on the basis of the Contents, (iii) interruptions, errors, viruses or security incidents not directly attributable to its wilful misconduct or gross negligence, or (iv) the future non-launch, delay or modification of any service, including any reservation system.
Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable mandatory law, including liability for fraud, wilful misconduct or for the rights of consumers where applicable.
9. Future Launch of Reservations and Additional Services
The Company reserves the right to launch, at any time, a reservation system, online payment functionality, customer accounts, loyalty programmes, memberships, mobile applications or additional services. The launch of any such service shall be governed by specific terms and conditions and, where applicable, by a separate privacy policy that the User must accept before using them.
The present Terms exclusively govern the current pre-launch phase and shall not be construed as committing the Company to launching any future service.
10. Modifications to the Terms
The Company may modify these Terms at any time to reflect legal, technical, business or organisational changes. The updated version will be published on the Website with an indication of its effective date. Continued use of the Website after such publication shall imply acceptance of the new Terms.
11. Personal Data Protection
The processing of personal data collected through the Website is governed by the Privacy Policy, which forms an integral part of these Terms.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with Spanish Common law, without prejudice to any mandatory provisions of EU law or of the law of the User’s country of habitual residence where the User acts as a consumer.
For any dispute arising from access to or use of the Website, the parties submit to the Courts and Tribunals of Madrid, Spain, unless the User acts as a consumer, in which case the legally applicable jurisdiction shall apply.

Los presentes Términos y Condiciones (los «Términos») regulan el acceso y uso del sitio web mosaicohostel.com (el «Sitio Web»), titularidad y operado por MOSAICO BOUTIQUE HOSTEL SL («nosotros», la «Empresa»).
La navegación por el Sitio Web atribuye la condición de Usuario e implica la aceptación plena y sin reservas de los presentes Términos. Si no está de acuerdo con alguna de las disposiciones establecidas a continuación, le rogamos que se abstenga de utilizar el Sitio Web.
2. Carácter Pre-Lanzamiento / Informativo del Sitio Web
El Sitio Web se encuentra, en la fecha de los presentes Términos, en fase pre-lanzamiento y tiene una finalidad exclusivamente informativa, promocional y de marketing. Presenta el concepto de marca del hostel, su experiencia, los tipos de habitación, artículos y contenidos para viajeros solitarios, nómadas digitales y otros públicos.
El Sitio Web no ofrece actualmente ningún motor de reservas, sistema de reservas, funcionalidad de pago en línea ni creación de cuentas de usuario. Cualquier contenido que describa habitaciones, precios, ubicaciones, aperturas, fechas o experiencias es meramente indicativo y no constituye una oferta comercial vinculante.
El envío de sus datos de contacto a través de cualquier formulario disponible en el Sitio Web no genera reserva, contrato de alojamiento, garantía de disponibilidad ni ninguna otra obligación vinculante entre el Usuario y la Empresa.
3. Ausencia de Contrato de Reserva / Ausencia de Garantía de Servicios Futuros
Hasta que un sistema de reservas se lance expresamente y se ponga a disposición en el Sitio Web con sus propios términos específicos, no se genera ninguna relación contractual de alojamiento, hostelería o servicio relacionado entre la Empresa y el Usuario.
La Empresa no otorga ninguna garantía, expresa o implícita, en relación con (i) la fecha de apertura del hostel, (ii) la disponibilidad de habitaciones, servicios, precios o experiencias, (iii) las ubicaciones geográficas referenciadas, ni (iv) el lanzamiento futuro de cualquier funcionalidad de reserva, pago o membresía.
La información publicada en el Sitio Web puede modificarse sin previo aviso. La Empresa se reserva el derecho a modificar, suspender o interrumpir cualquier contenido, página, sección o funcionalidad, incluido el proyecto en su totalidad, en cualquier momento y sin responsabilidad.
4. Uso Aceptable del Sitio Web
El Usuario se compromete a utilizar el Sitio Web de forma diligente, lícita y conforme a los presentes Términos, a la buena fe y al orden público. En particular, el Usuario no podrá:
(a) utilizar el Sitio Web con fines ilícitos, fraudulentos o lesivos;
(b) introducir virus, malware o cualquier tecnología que pueda dañar el Sitio Web o sus sistemas;
(c) intentar acceder sin autorización a cualquier parte del Sitio Web o de sus sistemas asociados;
(d) recopilar datos del Sitio Web por medios automatizados sin consentimiento previo por escrito;
(e) reproducir, copiar, distribuir, transformar o comunicar públicamente los contenidos del Sitio Web más allá de lo permitido por la legislación aplicable o por los presentes Términos;
(f) utilizar el Sitio Web de forma que pueda dañar, deshabilitar, sobrecargar o deteriorar su funcionamiento.
La Empresa se reserva el derecho a denegar o restringir el acceso al Sitio Web, sin previo aviso, a cualquier Usuario que incumpla los presentes Términos o la legislación aplicable.
5. Edad Mínima y Menores
El Sitio Web está destinado exclusivamente a usuarios mayores de dieciocho (18) años. Al acceder o utilizar el Sitio Web, o al facilitar cualquier información a través de sus formularios, el Usuario declara y garantiza tener al menos 18 años y la capacidad legal necesaria para aceptar los presentes Términos.
El contenido del Sitio Web —incluyendo, a título enunciativo y no limitativo, la información dirigida a viajeros solitarios, nómadas digitales y los contenidos relacionados con viajes, estilo de vida y alojamiento— está concebido para un público adulto.
Los formularios de newsletter, lista de espera, interés y contacto no pueden ser cumplimentados por menores de 18 años. La Empresa no recoge conscientemente datos personales de menores a través del Sitio Web. Si la Empresa tuviera conocimiento de que se han facilitado datos personales de un menor, procederá a su supresión sin dilación indebida y podrá suspender el acceso al Sitio Web.
El acceso al Sitio Web por parte de un menor se realizará bajo la exclusiva responsabilidad y supervisión de sus padres o representantes legales, quienes serán responsables del uso que se haga del Sitio Web y de los datos que, en su caso, se faciliten a través del mismo.
Los requisitos de edad mínima aplicables a futuros servicios de reserva, check-in o alojamiento se establecerán en los términos y condiciones específicos que regulen dichos servicios en el momento de su lanzamiento, y podrán diferir de la edad mínima establecida en la presente sección.
6. Propiedad Intelectual e Industrial
Todos los contenidos del Sitio Web —incluyendo, a título enunciativo y no limitativo, textos, gráficos, logotipos, iconos, imágenes, fotografías, contenidos audiovisuales, nombres comerciales, marcas, software, código fuente, diseño, estructura, selección y disposición de contenidos (los «Contenidos»)— son propiedad exclusiva de la Empresa o de sus licenciantes, y están protegidos por la legislación española y de la UE en materia de propiedad intelectual e industrial.
El acceso al Sitio Web no otorga al Usuario ningún derecho o licencia sobre los Contenidos, más allá de lo estrictamente necesario para su consulta. Queda prohibida cualquier reproducción, distribución, comunicación pública, transformación o uso de los Contenidos no autorizada expresamente por escrito por la Empresa.
La marca MOSAICO, su logotipo y cualquier signo distintivo asociado son marcas o nombres comerciales protegidos a favor de la Empresa. Su uso sin autorización podrá dar lugar a responsabilidad civil o penal.
7. Enlaces Externos y Contenidos de Terceros
El Sitio Web puede contener enlaces a sitios web o plataformas de terceros (incluyendo redes sociales). Dichos enlaces se proporcionan únicamente para comodidad del Usuario. La Empresa no controla el contenido, las políticas o las prácticas de dichos terceros y no asume ninguna responsabilidad sobre ellos.
El acceso a sitios web o servicios de terceros desde el Sitio Web se realiza por cuenta y riesgo del Usuario y se rige por los términos y políticas de privacidad de dichos terceros.
8. Limitación de Responsabilidad
El Sitio Web y sus Contenidos se ofrecen «tal cual» y «según disponibilidad». En la máxima medida permitida por la legislación española y de la UE, la Empresa excluye cualquier garantía, expresa o implícita, respecto de la exactitud, integridad, fiabilidad, disponibilidad, idoneidad para un fin determinado o no infracción de los Contenidos.
La Empresa no será responsable de daños directos, indirectos, incidentales, consecuentes o especiales derivados de (i) el uso o la imposibilidad de uso del Sitio Web, (ii) cualquier decisión adoptada o acción realizada con base en los Contenidos, (iii) interrupciones, errores, virus o incidentes de seguridad no directamente imputables a su dolo o negligencia grave, o (iv) el no lanzamiento futuro, retraso o modificación de cualquier servicio, incluido cualquier sistema de reservas.
Nada en los presentes Términos limitará o excluirá responsabilidades que no puedan ser limitadas o excluidas en virtud de la legislación imperativa aplicable, incluyendo la responsabilidad por dolo, fraude o derechos de los consumidores cuando proceda.
9. Lanzamiento Futuro de Reservas y Servicios Adicionales
La Empresa se reserva el derecho de lanzar, en cualquier momento, un sistema de reservas, funcionalidad de pago en línea, cuentas de cliente, programas de fidelización, membresías, aplicaciones móviles o servicios adicionales. El lanzamiento de cualquiera de tales servicios se regirá por unos términos y condiciones específicos y, en su caso, por una política de privacidad separada que el Usuario deberá aceptar antes de utilizarlos.
Los presentes Términos regulan exclusivamente la fase pre-lanzamiento actual y no podrán interpretarse como un compromiso de la Empresa de lanzar ningún servicio futuro.
10. Modificaciones de los Términos
La Empresa podrá modificar los presentes Términos en cualquier momento para reflejar cambios legales, técnicos, comerciales u organizativos. La versión actualizada se publicará en el Sitio Web con indicación de su fecha de entrada en vigor. El uso continuado del Sitio Web tras dicha publicación implicará la aceptación de los nuevos Términos.
11. Protección de Datos Personales
El tratamiento de los datos personales recogidos a través del Sitio Web se rige por la Política de Privacidad, que forma parte integrante de los presentes Términos.
12. Legislación Aplicable y Jurisdicción

Para cualquier controversia derivada del acceso o uso del Sitio Web, las partes se someten a los Juzgados y Tribunales de Madrid, España, salvo que el Usuario actúe como consumidor, en cuyo caso será de aplicación la jurisdicción legalmente competente.
